A judge has denied Nipsey Hussle’s alleged killer, Eric Holder’s motion to have his murder charge dismissed.
Last month his defense attorney tried to get two of his Holder’s six charges dropped. He is currently facing one count of murder, two counts of attempted murder, two counts of assault with a deadly weapon, and one count of felony possession of a firearm. His lawyers motioned to have his two attempted murder counts dismissed.
Nipsey was gunned down outside of his clothing shop, The Marathon Store, in March. The pair engaged in a heated exchange before he left the scene and returned with two firearms, killing Hussle and injuring others.
The report stated that Holder’s defense attorney wants to charges dismissed because they rest on the “Kill Zone” theory.
“In order for the “Kill Zone” theory to apply when determining attempted murder, six factors must be proven: there is a primary target, type of weapon used, distance between the shooter and target, proximity to other victims to target, whether victims are in an enclosed area, and whether the target was moving in the attack.”
