Kevin Spacey will not be charged in the second sexual assault case against him after the accuser passed away.
Los Angeles prosecutors made the decision that it could not move forward without the participation of the accuser. His accuser died over the summer.
“During the course of the investigation, the victim passed away,” Los Angeles County District Attorney Deputy Christina Buckley wrote per Variety. “The sexual assault allegations cannot be proved without the participation of the victim. Thus the case was declined.”
The identity of his accuser was never identified. The accuser went to the Los Angeles County Sheriff’s Department, which referred the investigation to the D.A.’s office in July 2018.
This is great news for Spacey, whose other case, involving an 18-year-old man who claims Spacey groped him at a bar in Nantucket in 2016, was dismissed by Massachusetts prosecutors after the accuser invoked his Fifth Amendment right not to testify about allegedly deleted text messages from the night of the incident.
Spacey has always maintained his innocence.
